Frequently Asked Questions for Employers

What is an LMIA and why do I need one?
An LMIA (Labour Market Impact Assessment) is a document from ESDC proving that hiring a foreign worker will not negatively affect the Canadian labour market. Most work permits require a positive LMIA. Without one, a foreign worker cannot obtain a work permit except in exempt cases.
How long does the LMIA process take?
Regular LMIA: 2-4 months. Global Talent Stream: 2 weeks. Duration includes advertising period (4 weeks minimum) and ESDC processing. Some sectors and provinces are faster than others.
What does an LMIA cost?
ESDC fee: $1,000 CAD per worker (non-refundable). Plus consulting service fees and advertising costs. Some categories are fee-exempt (e.g., caregivers).
Can I hire a foreign worker without an LMIA?
Yes, in exempt cases: Francophone Mobility, Intra-Company Transfer (ICT), trade agreements (CUSMA/CETA), spouses of work permit holders, graduates (PGWP), and other cases.
What are my obligations as an employer after LMIA approval?
You must comply with LMIA conditions: same wage, same working conditions, keep records for 6 years, notify ESDC of changes, cooperate with inspections. Non-compliance leads to fines and bans.
What is Global Talent Stream and am I eligible?
GTS is a fast-track for tech talent. Category A: referral from designated partner (accelerators, incubators). Category B: hiring for a GTS-listed occupation (e.g., software engineer). Processing within two weeks.
What is Francophone Mobility and how can I benefit?
A program allowing LMIA-exempt hiring of French-speaking workers (CLB 5+ in French) outside Quebec. Ideal for employers in Ontario and other provinces. Workers get additional CRS points for PR.
What happens if I fail an inspection?
Penalties range from warnings to fines up to $100,000 per violation, and hiring bans of 1-10 years. Good preparation and ongoing compliance are essential.
